Terms and conditions
Paddle Pembrokeshire Ltd operates a range of paddle sports in Pembrokeshire and other venues across the UK and is herein referred to as ‘PP’, ‘We’, or ‘Us’. ‘Activities’ means any training course, guided tour or other activity offered or provided by us.

1. Bookings and Payment

All bookings are subject to these terms and conditions; and these terms and conditions shall constitute the entire agreement between you (‘the Customer’ also referred to as a ‘Participant’ or ‘You’) or the person making the booking on your behalf, and PP. Payment of deposit or balance for an activity indicates acceptance of these terms.

Bookings and payments can be made on our website for most activities.

Bookings can also be made provisionally by email or telephone (e.g. for private sessions),but can only be confirmed upon receipt of a deposit (where the total fee is more than £120) or full payment (where the total fee is less than £120). The deposit is 50% of the full activity fee.

The final balance should reach PP no later than 7 days before the start of the activity. Bookings made within 7 days of the start of the activity must be paid for in full at the time of booking. Late payments will attract a late payment fee of 15% (calculated monthly). All goods and services remain the property of PP until paid for in full.

Payment can be made on our website, by telephone, or in person using debit/credit card or Apple Pay/Google Pay, or by bank transfer (written remittance advice is required). We can accept cheques from organisations, but not personal cheques.

For bookings made by organisations, an official purchase order or other written document against which we can raise an invoice may be acceptable in lieu of full advance payment.

Payment of invoices is strictly 30 days from date of invoice. We reserve the right to charge statutory interest on late payments (8% plus the Bank of England base rate), and debt recovery costs if proceedings are taken against you.
2. Cancellations/changes by us

Every attempt will be made to ensure activities run as scheduled. However, we reserve the right to:

Cancel an activity at any time should the numbers fail to reach a viable minimum;

Cancel or curtail any activity at any time due to unsuitable conditions, forecast or prevailing weather conditions, or due to any other factors beyond our control; and or
-
Change bookings if we deem the participant to be unsuitable for the activity

Cancel an activity for any other reason upon giving the Customer not less than 7 days’ notice.
2. We will endeavour to offer a suitable alternative activity which may include other venues or alternative dates, but if unable to do so or if the alternative activity offered is unacceptable to the customer a full refund will be made for all cancelled sessions, calculated pro rata where applicable.
3. PP shall have no liability arising from cancellation other than as set out in clause 2.1 above.
3. Cancellations/changes by you

We understand that things don't always go to plan. If you need to cancel or transfer your booking please notify us immediately at info@paddlepembrokeshire.

Cancellations/amendments more than 30 days before the course/activity starts: full amount is refunded, less a £15 admin fee.

Cancellations 7 days or more are charged up to 50% of course fee.
-
Cancellations/amendments 48 hrs or less before the course starts will be liable for 100% of course fee.

Wherever possible we will always try to rebook you on an alternative date.

If you reduce rather than cancel your booking (e.g. fewer participants or fewer sessions) then the above charges will apply pro rata only to the part of your booking being reduced.
4. Certificates

Course participation does not mean a certificate will be awarded automatically

Certificates will only be awarded if the coach considers that the participant has met the appropriate requirements to pass

Paddle UK is the governing body for UK paddle sports. The cost of certification or registration with Paddle UK is not included in our course fees
5. Insurance and loss of property
-
We carry full public liability insurance, but we recommend you take out appropriate personal accident and cancellation insurance for your activity, along with insurance for any of your own equipment (e.g. phone, camera). If you already have insurance, please check it covers you for the activities you will be undertaking with us.

PP will only accept liability for loss, damage or injury resulting directly from the negligence of PP, its servants, or agents.

We must be notified of lost property within 2 weeks, as any items found will be disposed of after this period.
6. Physical Fitness/Swimming ability
-
The activities offered can be physically demanding. In submitting a booking you are representing that you, or the person on whose behalf you are submitting the booking, have an adequate level of fitness for the activities to be undertaken.

Everyone taking part in a water-based activity unable to swim 25 metres in light clothing must inform PP before the activity.
-
If there are multiple non-swimmers, or physical and/or learning disabilities within a group, a higher instructor to student radio may be required. As a result a higher course fee may need to be charged.
7. Safety
-
Safety is of paramount importance on all PP activities, but all participants and their parents and guardians must acknowledge that water sports can be hazardous by their nature and accept the risks of participating in the same.

All participants must comply at all times fully and promptly with all safety regulations and instructions issued by PP, its staff and/or its instructors.

Participants must not do anything (or omit to do anything) which may cause damage or loss to the property or facilities of PP or other participants; or cause nuisance, annoyance, disturbance, inconvenience or injury to any other participants or members of the public.

Any wilful or negligent damage to PP property will be charged for.

PP reserves the right to terminate the use of its property by any person(s) whom it reasonably considers to be in breach of these conditions and such persons may be required to leave the activity forthwith. No refunds will be made in this event, and PP will not accept liability for any expenses, claims, losses or costs incurred as a result of such termination.

8. Clothing and Equipment

You must be properly equipped for the course or activity which you have booked. We will send you a list of clothing and other equipment required, along with a list of what we will provide for you. Any client who is not so equipped may be excluded from the course or activity without refund of the fees paid.
9. Instructors
-
We reserve the right to use any suitably qualified person to instruct, coach or lead on courses and activities - as a minimum such individuals will have appropriate Paddle UK qualifications. Instructor/student ratios are in accordance with Paddle UK guidelines.
10. Medical declarations
-
If you have a medical condition or illness, including but without limitation to; pregnancy and heart conditions, back conditions, previous injuries, or any condition which may affect your ability to take part, you must disclose this on your registration form, and seek the advice of your doctor before submitting your booking.

You must also indicate upon booking if you have any disability, impairment or condition, or special requirements, of which we may reasonably need to be aware.
11. Under 18 Participants

All persons under the age of 18 years (‘Under 18’s’) will require a consent form to be completed by a parent or guardian before being allowed to participate on a course.

We cannot accept responsibility for Under 18’s until the course start time; and they must be met promptly by a parent or guardian at the course finish time.
12. Errors and Omissions
-
Whilst every effort is made to ensure the accuracy of PP’s promotional information, PP does not accept liability for any errors, inaccuracies or omissions therein, and reserves the right to alter activity prices, times or dates at any time. Please check all activities and prices before making your booking.

You will be informed of any relevant changes when your booking is processed and will be given the opportunity to cancel your booking without penalty if you wish.
13. Data Protection/Privacy

The information you have supplied will be treated in accordance with the provisions of the Data Protection Act 1998, and PP is registered with the Information Commissioner’s Office for this purpose. All personal data from your registration form will be held for 3 years (and until the 21st birthday for minors) for Insurance claim purposes only.

We may take photographs of participants for publicity purposes, including for reproduction on our website and/or social media, and in submitting your booking you are indicating your consent to the same, unless you indicate otherwise on the booking form.

By accepting the Terms and Conditions of PP you are consenting to your name, date of birth, postcode, gender and email address being passed on to Paddle UK, the governing body for paddle sports in the UK. This will be used for statistical reporting to support with monitoring participation. Personal data will be used only in accordance with Paddle UK’s notification under the Data Protection Act 1998. Your contact details will not be passed to any other third parties without your consent.
